Derecho del paciente en la atención por profesionales de la salud, aplicación de la Ley 26.529 en el servicio de radiología del Hospital Juan B. Sartori de Mayor Buratovich

Abstract

El Senado y Cámara de Diputados de la Nación Argentina reunidos en el Congreso, sancionaron el 21 de octubre del 2009 y promulgaron el 19 de noviembre del mismo año, la Ley 26.529: Derecho del Paciente en su Relación con los Profesionales e Instituciones de la Salud. Dicha Ley se compone de 5 Capítulos y 25 artículos con sus respectivos incisos donde se desarrollan: Derechos del Paciente en su Relación con los Profesionales e Instituciones de la Salud, Información Sanitaria, Consentimiento Informado, Historia Clínica y Disposiciones Generales. Realicé una investigación para comprobar si en el área de diagnóstico por imágenes del Hospital Juan B. Sartori de Mayor Buratovich se cumple esta Ley. Para eso hice énfasis solo en el Capítulo 1, Derecho del Paciente en su Relación con los Profesionales e Instituciones de la Salud: artículo 2° - inciso a) Asistencia, b) Trato digno y respetuoso, e) Autonomía de voluntad y f) Información Sanitaria; y Capitulo 2 La Información Sanitaria: 3° y 4°. El derecho es el conjunto de reglamentaciones, leyes y resoluciones, enmarcadas en un sistema de instituciones, principios y normas que regulan la conducta humana dentro de una sociedad, con el objetivo de alcanzar el bien común, la seguridad y la justicia. La información sanitaria es aquella que, de manera clara, suficiente y adecuada a la capacidad de comprensión del paciente, informa sobre el estado de Salud, los estudios y tratamientos que fueren a realizarle y la previsible evolución, riesgos, complicaciones o secuelas de los mismos. Para verificar el cumplimiento de dicha ley, la recolección de datos se obtuvo mediante encuestas anónimas a una muestra de 500 personas entre 21 y 60 años, que se atendieron en el Hospital Juan B. Sartori de Mayor Buratovich en el período de 5 meses, desde el 2 de noviembre del 2021 al 2 de abril del 2022. Como conclusión de la investigación, el 91% de los encuestados no se sintió discriminado, mientras que un 9% (47 encuestados) dijo que sí. De esos 47 encuestados, 20 dijeron que fue por situación socioeconómica, 9 por nacionalidad, 8 por su peso, 4 por comentarios fuera de lugar, 3 por su orientación sexual, 2 por no tener obra social y por discapacidad. Respecto al cumplimiento de mis objetivos específicos pude determinar que la población de Mayor Buratovich considera que el T.R brinda un trato digno y respetuoso, y se le brinda la información Sanitaria correspondiente y necesaria.

The Senate and Chamber of Deputies of the Argentina Nation gathered in Congress, sanctioned on October 21, 2009 and promulgated on November 19 of the same year Law 26529: Right of the Patient in his Relationship with Health Professionals and Institutions. Said Law is made up of 5 Chapters and 25 articles with their respective subsections where they are developed: Patient Rights in their Relationship with Health Professionals and Institutions, Health Information, Informed Consent, Clinical History and General Provisions. In this work, I carried out an investigation to verify if this Law is complied with in the diagnostic imaging area of the Juan B. Sartori Hospital in Mayor Buratovich. For that, I only emphasized Chapter 1, Patient Rights in their Relationship with Professionals and Institutions. of Health: article 2 - subparagraph a) Assistance, b) Dignified and respectful treatment, e) Autonomy of will and f) Health Information; and Chapter 2 Health Information: 3rd and 4th. The Law is the set of regulations, laws and resolutions, framed in a system of institutions, principles and rules that regulate human behavior within a society, with the aim of achieving the common good, security and justice. The Health Information is that which, in a clear, sufficient and adequate way to the patient's ability to understand, informs about the state of Health, the studies and treatments that will be carried out and the foreseeable evolution, risks, complications or sequelae of the same. To verify compliance or non-compliance with said Law, data collection was obtained through anonymous surveys of a sample of 500 people between 21 and 60 years of age, who have been treated at the Juan B. Sartori de Mayor Buratovich Hospital in a period of 5 months, from November 2, 2021 to April 2, 2022. As a conclusion of the research, 91% of those surveyed didn’t feel discriminates against, while 9% (47 respondents) said they did. Of those 47 respondents, 20 said it was due to socioeconomic situation, 9 due to nationality, 8 due to their weight, 4 due to inappropriate comments, 3 due to their sexual orientation, 2 due to not having social work and due to disability. Regarding the fulfillment of my specific objetives, I was able to determine that the population of Mayor Buratovich considers that the TR provides dignified and respectful treatment, and is provided with the corresponding and necessary Health information.
