Libra: su principio, su cambio y algunos análisis preliminares sobre los datos personales y la regulación

Abstract
Nos encontramos en la era de la transformación digital y esto impacta en las formas en que llevamos adelante nuestras actividades cotidianas y económicas. Entre ellas podemos mencionar la manera en que nos
relacionamos con el dinero y los medios de pago que en este último tiempo han evolucionado y crecido
exponencialmente. Este documento está enmarcado dentro de un grupo de investigación actual de la Facultad Regional Buenos Aires de la Universidad Tecnológica Nacional (UTN-FRBA), que busca analizar
algunos aspectos vinculados a las criptomomedas y cómo ello influye en el funcionamiento del Estado. Si
bien el artículo se basa en temas, vinculados a los que fue Libra, la cripto de FaceBook, los autores entendemos que podría contribuir al entendimiento de un tema tan complejo que avanza en el mundo entero.
Hemos focalizado el trabajo en dos aspectos: el tema de datos personales y regulación financiera. Se repasa
la legislación argentina en cuanto al tema de los datos personales y entender cómo sería la aplicación de
la misma en función de lo que plantean los creadores de Libra (en su momento inicial). Por otro lado, se
revisaron aspectos de la regulación financiera local e internacional para entender la viabilidad del uso de
Libra como medio de pago y habitual en nuestro país.
We are living in the era of digital transformation and this impacts the ways and forms in which we carry out our daily and economic activities. Among them we can mention the way in which we relate to money and the means of payment that in recent times have evolved and grown exponentially. This document is framed in the context of a Facultad Regional Buenos Aires de la Universidad Tecnológica Nacional (UTN-FRBA) research group that seeks to analyze some aspects related to cryptocurrencies and how this influences the State functions. Although the article is based on topics, linked to what Libra was (the crypto of FaceBook) the authors understand that it could contribute to the understanding of such a complex issue that it advances throughout the world. We have focused our work on two aspects: implications on the subject of personal data and financial regulation. It is mainly focused on reviewing Argentine legislation on the subject of personnel data and understanding how it should be applied based on what the creators of Libra propose. In addition, aspects of local financial regulation are reviewed to understand the viability of using Libra as a means of payment and it’s adoption in our country.
